Two-Step Licensing Approach
New Jersey’s cannabis licensing process is designed to be both structured and accessible, following a two-step system that helps streamline the journey for aspiring business owners. The first step involves applying for a conditional license, which is an initial, temporary license that allows applicants to submit their initial plans, which include business, financial, safety & security, and a few others. During this phase, applicants aren’t required to have their business fully established, but they do need to complete key tasks to remain eligible for the next step: the conversion application.
In this 120-day window, applicants must first secure control of their real estate, whether through purchase or lease, ensuring that they have a dedicated location for their cannabis operations. Next, they must seek approval from their local municipality, obtaining municipal and zoning clearances to confirm that their business is legally compliant in their chosen location. Once these steps are completed, applicants can then submit a conditional license conversion application. This second application transforms the conditional license into a full, annual license. This two-step process allows for a smooth transition from the planning stage to full operations while ensuring businesses meet all legal requirements.

Regulation Updates
Earlier in September, Gov. Murphy signed into law a new bill that places intoxicating hemp products under the same regulatory system governing state-legal cannabis companies, which is controlled by the New Jersey Cannabis Regulatory Commission (CRC). Any existing retailers selling such hemp products – ranging from gas stations to convenience stores and liquor stores – have until mid-October to take those products off the shelves. That product moratorium will last at least 180 days, at which point the commission is mandated to have the new hemp rules finished. New Jersey is the latest state in regulating the hemp industry, following the footsteps of California and Missouri.
